As is known to all, the CBEC & its organizations have moved ahead on the path of Cadre Restructuring without taking into considerations the submissions made by this Association time & again. This unilateral move of CBEC has failed to deliver justice not only to Cadre but is against the aims & objectives of CR, causing a lot of litigations in the Hon’ble CAT Benches at New Delhi, Ahmedabad, Mumbai etc. This is a serious situation where either way the interest of the Cadre is at stake.
The Office-Bearers of the National Body of this Association discussed the ongoing scenario and brought the matter to the competent authority at New Delhi which in turn invited us for a discussion. It was decided that the Association would be represented by a delegation consisting of Abhishek Kamal, Secretary General, Shri Devender Kumar, Liason Secretary and Shri Rananjay Pratap Singh, Vice-President representing West Zone.
The delegation called on DG (HRD) on 25.09.2014 and requested her to adopt a formula which may pave the way for smooth implementation of CR as the same is beneficial to the Cadre as well as to the Department. The delegation was of the view that the promotion should immediately be given to the Inspectors, who joined department before All India Merit List but Promotion should not be effected to the batch which joined due All India Examination, without implementation of All India Seniority. The delegation apprised her regarding the stagnation continuing in Zones like Shillong, Lucknow/Meerut, Kolkata, Cochin, Jaipur, Bhopal, Patna etc. even after the implementation of Cadre Restructuring and requested her to take appropriate measures to remove the stagnation in these Zones and regional disparities in promotion. The DG (HRD) seemed convinced that in principle All India Seniority is the only way to address regional disparities in promotion to the grade of Superintendent & to remove stagnation of poor Zones, but expressed her inability in giving effect to it since SSC-1996. On the basis of facts and figures, the delegation suggested many ways to implement All India Seniority from SSC-1996. The DG (HRD) expressed hope that All India Seniority may be implemented from 2014, on this, the delegation asserted that the same should be from SSC-1996 itself i.e. from the time when the first batch of Inspectors was recruited on All India Basis. This was countered by DG (HRD) citing the huge inconvenience but the argument was nullified by the delegation citing the recent judgment of the Hon’ble Supreme Court in the case of N R Parmar v/s. Union of India where the Hon’ble Court has clarified that inconvenience can never be cited as a cause to subvert justice. The delegation also suggested a workable formulae to fill the remaining vacant posts of Superintendents in well off Zones by way of giving promotions to the Inspectors of stagnated Zones and posting them against the vacant posts of well off Zones, but, the DG (HRD) seemed to be non-committal on this. Discussions were also held regarding the implementation of judgment of the Hon’ble Supreme Court in the case of N R Parmar v/s. Union of India.
The delegation also called on other officials at North Block on 26.09.2014 and discussed the impact of Cadre Restructuring on our Cadre. Regarding our query about uneven and unjustified posts allocations in Cadre Restructuring, nobody was able to respond. The delegation suggested ways to address genuine grievances of the Cadre and showed its apprehensions and displeasure on poor functioning of the Study Group. It was also brought to the knowledge of the delegation that a Meeting with the Study Group may be fixed with recognized Staff Associations in the second week of October, 2014, which may be the last meeting of the study group before it submit its report.
Apart from the above, the delegation also called on other important dignitaries, who have very crucial role to play in weeks to come in achieving the goals of the AICEIA for which the Association is committed.

It is indeed a great challenge, opportunity and pleasure to serve you all in fighting for the issues of the Inspectors and to bring the best career prospects and healthy working environment. For this, we need continuity in active involvement of every Inspector in the Association’s activities, a regular and meaningful two-way communication from the All India office bearers right to the grassroots level formations, enhancing the legal, intellectual and financial resources and mobilization of all members throughout country. So Comrades, if the largest working force of the CBEC will achieve their rights, remember it is the country too that will achieve wonders and a position of pride.

Executive Body Meeting, 06.06.2014 @Bodhgaya
The Executive Body Meeting of the AICEIA, Patna Circle has been held on 06.06.2014 at Bodhgaya. Following issues/agenda were discussed during the Meeting:-
Welcome Address by the President, Minutes of Last GB Meeting, ATR, Cadre Restructuring, AGT-2014. Legal Fund, Website related matters, Presentation of Audited Accounts of the Association, MACPS, Training of Inspectors, All India Seniority, Discussion on court/CAT cases and many more organisational issues.
The Minutes of the Meeting is under preparation and the same will be available soon.
Further, the Welfare Fund of the Association was discussed for the relief of the families of the deceased/Total Permanent Disabled (as defined by LIC) Inspectors who are members of this Welfare Fund. The details of the proposed Welfare Fund has been presented during the Meeting and posted below for discussion. You are requested to go through it and give your views so that the same may be started in next General Body meeting.

Meeting on All India Seniority for Inspectors
A meeting was held today in the DGHRD office at Rajendra Place, New Delhi, which was attended by the Committee appointed by the CBEC (to study issues concerning proposed All India Seniority for Inspectors of Central Excise and their Customs counterparts) and office bearers of Associations representing Gr B Executives of both Excise and Customs sides. DG - HRD chaired the meeting. Chief Commisioner, Delhi Customs, ADG HRM and several other senior officials of the CBEC and DGHRD were present in the meeting.
AICEIA reiterated our earlier submissions made under letter dated 12. 05.2014 and also the fresh points raised in our letter (text reproduced hereunder) handed over during the course of today's meeting.

Sub: Unification of Group B Non- Gazetted Executive grades into three AI cadres - Reg
Madam,
Please refer to the DGHRD, CBEC OMs on the captioned subject issued under F. No. 8/B/36/HRD(HRM)/ 2014 Part- I dated 07.05.2014 and 09.05.2014, and this Association’s letter of even no. 2 dated 12.05.2014 in response to the same, further to which the following submissions are made :
1. Apart from the Judgment of the Hon’ble Supreme Court in the Radheshyam Singh case, the provisions laid down by DoP&T as regards Seniority too mandate all India Seniority for all Inspectors who have been recruited by an All India Merit List:-
“2.1. SENIORITY OF DIRECT RECRUITS
The relative seniority of all direct recruits is determined by the order of merit in which they are selected for such appointment on the recommendations of the U.P.S.C. or other selecting authority, persons appointed as a result of an earlier selection being senior to those appointed as a result of subsequent selection. (O.M. No. 20011/5/90-Estt (D) Dated 4.11.1992)”
2. Para 2.3 (page 3) of the Board Brief (F.No. 8/B/36/HRD(HRM)/2014) does not represent wholly true facts inasmuch as the assertion that “Even though the selections are made on the basis of all India Merit List, allocation of selected candidates is done on the basis of merit-cum-preference basis to various zonal /Commissionerate based cadres. Allocation of the grade, viz. Inspector CE, Preventive Officer or Examiner, is also done on the basis of thepreference indicated by the selected candidates at the time of submission of application for CGLE to the Staff Selection Commission.” is not correct . Information available indicates that for 1996(1999), 2003, 2004 & 2005 batches the process of allocation was not as per the above mentioned scheme. Promotion prospects for Inspectors (to the grade of Superintendent) / extant or projected relative levels of stagnation have obviously never been a criteria adopted for allocation of Zones to a newly recruited Inspector.
3. The very first paragraph of the aforesaid Board Brief (page 2) states that “it is necessary to ensure that the legitimate aspirations of the officers and staff for promotions and upward movement in the hierarchy of the department are adequately addressed, as far as possible, in the present cadre restructuring exercise or even after that.” This Association welcomes this assertion of the DGHRD, and reiterates its submissions made countless times earlier that the Cadre Restructuring is an instrument to address such vexatious issues, and enhance career prospects ofall cadres, and it has to be essentially implemented in a manner to resolve issues such as these. The CBEC’s visualization that “zonal/cadre disparities in promotional avenues will gradually disappear with passage of time” is not acceptable to this Association, as such an attitude would be abdication of responsibility to positively intervene in a situation of grave and long-standing injustice even when an unprecedented opportunity is afforded for addressing conclusively these matters. It may also kindly be noted that this Association and the cadre it represents have been repeatedly assured by the Board over the past many years that come CR and the regional disparities plaguing it will be done away with.

We have emphatically impressed upon the Committee that our demand is that All India Seniority must be introduced beginning the first batch of Inspectors recruited on an All India Merit List inducted in the Department in 2003, and that all Inspectors senior to them in all Zones must be promoted prior to that. We have also informed that if this is not accepted, there will most certainly be serious litigation immediately.
A point was sponsored in the Meeting by the AIACEGEO, the Assn representing Supdts of Central Excise that what was needed was to bring parity among all the 3 executive base cadres in the Deptt., and our Association extended full support to the same, and pointed out that vide letter dated 28.12.2012 and on various other occasions we have voiced this demand unequivocally, and that the AICEIA views the removal of regional disparites among Inspectors from various Central Excise Zones as an important step in this direction.
An extremely unfortunate development was when during today's meeting the Secretary General of the AIACEGEO vehemently opposed our demand for introduction of All India Seniority and upgradation of all Inspectors with 12 or more years of service stating that it would greatly inconvenience them (Superintendents) with fewer Inspectors to assist them in many Zones, and that if Inspectors have to move to other Zones on promotion as Superintendents, the apprehension of All India Transfer liability could arise in Supdts' cadre. We did counter this argument saying that the Supdts cadre is functioning presently without any difficulty without AI transfers, and the only relaxation required in the new dispensation suggested by us was that transfers on requests may be allowed to Supdts wishing to be repatriated to their home zones if they have had to move out to other Zones on promotion on account of vacancies in the higher grade not being available in their home zones at the time of their promotion.
Equally disturbing was the Superintendents' Assn SG's repeated insistence during today's meeting for amendment of RRs of Supdts to reduce the residency period for promotion of Inspectors of Central Excise to Superintendents from eight years to two years, even as the AICEIA forcefully advanced its position that any reduction of minimum qualifying service should be considered only after regional disparities in promotions are completely done away with in the Inspectors' cadre.
The Office Secretary of the Central Excise Superintendents' Association who also attended the meeting today with his SG, in a vicious attack on our Association, said that Resolutions of AICEIA need not be considered seriously as opinions of the C. Ex Inspectors' cadre since CEC meetings or Conventions are attended by hardly a hundred Inspectors whereas the cadre itself is about 17000 strong. AICEIA office bearers raised objections to this immediately, and made it clear that we cannot accept casting of such aspersions on our organisation. The DG HRD and the CC Delhi Customs agreed with our contentions and advised the Supdts' Assn office bearers to confine their submissions to functioning of their own Association.
The Committee shall now compile the different Associations' views and in light of the same submit its report to the CBEC, which, in turn, will take a final call in the matter.
It was also informed that notifications in respect of jurisdiction of new formations and staff allocations as part of CR shall be issued by the end of this week.

Chairperson's note dated 19.05.2014 regarding implementation of the Cadre restructuring
Message from Chairman-II
Greetings to the officers and staff of the IC&CE. This message is in continuation of my earlier message dated 12.5.2014. As I had mentioned the implementation of the CR has to be taken up in right earnest, but it will require patience and perseverance. I have got a number of communications urging that immediate DPCs be held as officers are retiring every month. There is a lot of anxiety as to how the CR is to be implemented. Through this message I would like to apprise to you all of the steps being taken at CBEC level and also reiterate to you those steps which are required to be taken by Cadre Controlling Authorities (CCAs).
You must have already gone through letter F.No. 8/B/106/HRD(M)/2013 dated 28.11.2013 issued by DG(HRD) giving the details of the 6 committees which had been set up for implementation of the CR. The action to be taken now, flows from the work of those committees.

The steps to be taken are as follows:
I. Issue of notification defining the jurisdiction of the reorganised zones/Commissionerates/ Directorates. Letters have already been issued to the CCs on 13.5.2014 to recheck and resubmit the notifications to be issued. These notifications are expected to be issued from the concerned wings of the CBEC by 23.5.2014. Sh. S.B. Singh, Member (CX) is monitoring this.
II. (a) Simultaneously, the notification regarding allocation of staff in the various grades for the revised formations have to be issued by AD-W section’ of CBEC. Member (P&V) is monitoring the timely issue of the notification on allocation of staff.
(b) On issue of notification for allocation of staff, all CCAs must work out the vacancy position, update rosters and inform the same within one week to Member (P&V) so that the number of fresh recruitments & category can be intimated to SSC. This is also monitored by Member (P&V).
III. Action for issue of notification for the amendments to various statutes based on revised designations has been undertaken by committee no. V. Some of the amendments are required to be introduced through Finance Bill since amendments to Act are involved. (Member (B) is monitoring the work of this committee). Other notifications are to be issued by Board. Member (B) would also examine the appropriate timelines for each.
IV. For all the new formations which are to come into existence, location codes have to be given. In addition there would be requirement for providing thin clients, infrastructure such as WAN/LAN etc. These matters are under the domain of Dte. of Systems and is being monitored by me.
V. Immediately after the issue of the notification mentioned in para I & II, infrastructure committee would be working out the requirements for additional space for the new formations and submit their infrastructure proposals (including Budget Requirement) after collecting and vetting the same. Member (CK) would be monitoring this.
VI. There are 2 other important activities. One is the conduct of DPCs for promotions to various grades in Group C and B by the CCAs.
(a) There are large number of cadres in group B 84 C. DPCs can be done in those cadres which do not require any change in RRs. Whereas in some other cases, new RP.s may have to be drafted or amendments may be required to the existing RRs. Member (P&V) would be intimating to the CCAs by 28.5.2014, the RRs in respect of those cadres where no change is required and for which DPCs can be held. This is necessary to ensure that DPCs are conducted in a coordinated manner across all the Zones.
(b) CCAs would recall that vide letter No. 8/B/106/HRD(HRM)/2013 dated 13.2.2014 a format had been prescribed to enable monitoring of APARS by the CCAs. It had been desired that all folders be in readiness by 1.4.2014. However, reports received from the CCAs indicate that still considerable work is required in some of the zones. It is reiterated that unless folders are updated and all action such as finalization of representations, NRC, vigilance certificate, rosters, etc. are ready, the CCA will not be able to conduct the DPCs. Member (L&J) has been nominated to monitor the readiness of the CCAs for holding the DPC in Group B and C cadres. She would also monitor the conduct of DPCs across all the zones. Member (LBJ) shall take up this action immediately on receipt of the list of RRs cleared by the Member (P&V).
VII. In so far as the promotions of 2118 officers of Group B to Group A is concerned, the zone of consideration would involve the verification and updated status of around 10,000 APARS. Letter dated 23.11.2013 of the DG(HRD) indicates that sub committee no.I of the committee no.II has been given the task of ensuring the readiness of the folders. Member (P&V) is reviewing the work of this committee. It will be the responsibility of every CCA to ensure that the APAR folders are complete and correct in all respects. CCAs may therefore contact the sub committee members to ensure that the folders in respect of group B officers belonging to their respective zones are complete and correct in all respects. Only thereafter, verification would be done by AD.II/JS(Admn.) before forwarding to UPSC. Further update on this shall be given after review. It is reiterated that unless the work of APAR verification is completed it would not be possible to move to UPSC for getting the date(s) for holding the DPC. You would all appreciate that DPC for 2118 officers is quite unprecedented, and one matter which will involve a lot of work for UPSC as well. Hence officers, staff & associations are requested to have patience, cooperate & assist the administration to the maximum so that this major activity can be carried out as smoothly & swiftly as possible.

Finance Minister clears the way for Restructuring, CBEC mulls All India Seniority for Inspectors
On 10.05.2014 the Finance Minister gave the go ahead for implementing CR in the CBEC. Notifications of the new formations and staff allocations are expected to be made public shortly. For our cadre the most important concern now is whether our long standing issues of stagnation and intra-cadre as well as inter-cadre disparities are addressed in the implementation of the CR, and if so, to what extent.
The present Committee of the AICEIA had made a promise to this cadre at the Patna Convention in December 2012 that we will not rest till regional disparities in promotions among the various Zones are not eliminated, and All India Seniority for Inspectors of Central Excise does not become a reality. We have not left any stone unturned in our efforts in this direction, and during the past many months there has hardly been a door left which we have not knocked seeking justice. The responses that our efforts have met with have varied from appreciation to ridicule, encouragement to fury, indifference to unstinted support. We have faced it all with equanimity, and we thank every single member of the Central Executive Committee for standing by us through these diffcult times. As the Restructuring unfolds in its implementation, it will be revealed to us how we are treated in this family.
Next month, there will be a change of guard in the AICEIA, and it is time now for our youthful comrades to take over the reins of this Association. I exhort the relatively fresh entrants into the cadre to come forward and lead from the front this organisation and strive to secure for themselves much better careers than those that we have seen - remember, most of us holding key positions in the organisation today have put in around twenty years of service as Inspectors, and we have only ourselves to blame for not foreseeing this plight much earlier and not having agitated unitedly and stridently for what is rightfully ours! Once All India Seniority is ushered in, I'm sure it'll be a far more united Association with commonality of interests, and a spirited movement can be launched for betterment of career prospects and service conditions for Inspectors.
The ADG(HRM), DGHRD, CBEC has issued an OM calling for views of Associations on All India Seniority for Inspectors after the Board has at last taken a decision in-principle to prospectively introduce All India Seniority for Inspectors and informing convening of a meeting to hold consultations on the issue. AICEIA has submitted its views today . Scanned copies of the subject OM and letter submitted by us in response are placed below. We hope that the Board will appreciate our perspective and will be alive to our concerns while taking a final call in this matter.

Once All India Seniority is ushered in, I'm sure it'll be a far more united Association with commonality of interests, and a spirited movement can be launched for betterment of career prospects and service conditions for Inspectors.
The ADG(HRM), DGHRD, CBEC has issued an OM calling for views of Associations on All India Seniority for Inspectors after the Board has at last taken a decision in-principle to prospectively introduce All India Seniority for Inspectors and informing convening of a meeting to hold consultations on the issue. AICEIA has submitted its views today . Scanned copies of the subject OM and letter submitted by us in response are placed below. We hope that the Board will appreciate our perspective and will be alive to our concerns while taking a final call in this matter.

A word of Caution
It has been brought to our notice that certain outfits impersonating as Branches/Circles/Units of the All India Central Excise Inspectors' Association are using the emblem, recognition details and other distinctive information/insignia of our Association and using them fraudulently on letterheads to correspond with the CBEC/ Ministry/ Govt. masquerading as representing/being the AICEIA or Regional Units of the AICEIA. It is also reported that a few individuals/groups of individuals having no connection whatsoever with the AICEIA have been collecting money/contributions/membership subscriptions from Inspectors of Central Excise of a few Commissionerates. While normally we would have ignored such devious elements with the contempt they deserve, at this crucial time for the cadre we have no option but to warn such elements that if such activities do not stop forthwith, AICEIA would not hesitate to lodge complaints in appropriate fora, and also initiate action as per law for fraud and impersonation. Confusion created by spreading of malicious rumours and submission of representations to the Board/ Ministry or other authorities by persons not authorised to do so, often containing false and misleading information will not be tolerated any longer, especially in view of the enormous damage done earlier by such unscrupulous elements' unauthorised activities.
Attention of all concerned is also invited to Board's Instructions stating that all communication with the CBEC or Ministry by Staff Associations have to be necessarily done only by their National Bodies and that it is mandatory that any correspondence from their regional/local formations/units have to be routed through the National Hqrs of the concerned Association for those to be even considered. Violation of this will invite disciplinary action against the offending individuals/units of the AICEIA, and the Board will also be requested not to entertain those and to take necessary action against those making such communication flouting Government regulations.
We exhort all Inspectors of Central Excise all across the country to unite and strengthen the hands of the AICEIA to ensure bringing in an era of equity among us first, and conditions where we can work with self-respect and dignity, and be assured of just and reasonable career advancement prospects for each one of us. Kindly do not give credence to rumours being spread with malicious intent, and do not give in to threats or inducements of any kind from any quarters, and indulge in any acts which would sow seeds of mistrust and disunity within the cadre, and would cause only detriment to overall interests of the fraternity in the longer run.

Strike on 12th and 13th of February 2014.
The Confederation of Central Government Employees and Workers has given this Strike call, and our Association has given notice accordingly, following the Confederation's call.
The Fifteen point Charter of Demands includes several demands crucial to service conditions particularly of our cadre. While the demands relating to 7th Pay Commission, Interim Relief, DA Merger etc are equally important to us as to employees of all Departments, a demand which is vital to Inspectors of Central Excise is that for an assured number of promotions to all employees. Another very important demand is for Rescinding the PFRDA Act and to ensure Statutory Pension for all. This is particularly vital to the later entrants to Government Service - we have a very large number of Inspectors who have joined the Department in 2006 and later.
Friends Be Unite and fight for our Rights. Be prepared for display of our strength on 12th and 13th Feb. 2014.
